Selling Article 50 gap assessments: a practical playbook for consultancies and agencies

Since 2 August 2026, every EU-facing product with a chatbot or generative AI feature has a live legal question: are we meeting Article 50? Why Article 50 is the right entry point
- It applies now. Unlike the high-risk regime (moved to 2027/28 — what was delayed and what was not), the transparency obligations of Regulation (EU) 2024/1689 apply since 2 August 2026, with fines up to EUR 15M or 3% of worldwide turnover (Article 99(4)(g)).

- It is assessable in days. The obligations are enumerable (paragraphs 1–5), the Commission has published guidelines and an FAQ, and the deadlines are fixed — including the 2 December 2026 marking deadline that gives your outreach natural urgency.
The engagement, step by step
- Inventory (with the client, ~1 hour). List every AI-powered surface: chatbots, agents, image/text generation, voice, avatars, synthetic media. Include features built on third-party APIs — the client can still be a provider or deployer.

Your name goes on the report, so say clearly what it is: an Article 50 transparency gap assessment against the published Regulation and Commission guidance. It is not a high-risk conformity assessment under Annex III, and not a substitute for legal advice on contested questions.
